Terms and Conditions

3D THAI PTY LTD Trading as THAi DAYS Restaurant permits you to access its business website in accordance with the following terms and conditions, provided that it is solely for your exclusive personal use. Text and graphics contained on our business website, all our printed menus and other printed documentation are the exclusive property of THAi DAYS Restaurant and may not be copied without the express written permission of THAi DAYS Restaurant.

You agree to indemnify the restaurant against all claims for damages and/or loss arising from your website access, including inappropriate use of the online ordering facility and application, breach of copyright and infringement of third party rights.

 

These terms and conditions are applicable to all customers using our website online ordering service (including the use of the application on your electronic device) and define your legal rights and obligations in our relationship with you. We encourage patrons to read them carefully. If you do not wish to be bound by these terms and conditions, you should not utilise the online ordering facility. If you choose to do so, it constitutes deemed acceptance of these terms and conditions.

 

We may, at our discretion, amend these terms and conditions from time to time within the relevant legal framework. It is in your interests to carefully read the current terms and conditions prior to ordering online.

  

Customers should be aware that the online ordering application is separately owned and operated by the licensor of the license agreement in relation to the online ordering facility. Without affecting the generality of the present terms and conditions, and for the sake of clarity, you are expected to respect the license agreement regarding the use of this application when ordering online. THAi DAYS Restaurant reserves the right to suspend the use of the online ordering application if you breach these terms and conditions.

 

THAi DAYS Restaurant aims to ensure that, as far as reasonably possible, the information in relation to online ordering is accurate and reliable. While we try to avoid errors, you should in any case satisfy yourself, prior to ordering, that all the information is correct. To the maximum extent permitted by law, the Restaurant disclaims any express or implied warranty or representation of any kind in relation to the online ordering facility including, without limitation, the actual availability of the online ordering application.

 

THAi DAYS Restaurant may find it necessary to revise the online ordering application information from time to time and reserves the right to make such changes without notice. In no circumstances shall THAi DAYS Restaurant be held liable for any direct, indirect, incidental, special, consequential or punitive damages or, indeed, any losses, costs, expenses or loss of profit arising out of the use of any information related to the online ordering process. By ordering online, you agree to do so entirely at your own risk. Likewise, links to third party external websites are accessed at the user's own risk and the Restaurant cannot be held liable in these circumstances.

  

The Restaurant's online ordering application is restricted to persons over the age of eighteen years.  

Refund Policy

THAi DAYS is bound by Australian Consumer Law to provide refunds in certain circumstances, such as food not being fit for consumption, meals being significantly different from the illustrated menu graphics or in the event of unsupplied meal orders.  The Restaurant is not required to provide a refund or replacement if you simply change your mind.

To obtain a refund or replacement, please return your uneaten meal to the restaurant or call us immediately, explaining the problem. If dining in, please ask to speak with the Manager.

If the problem is not major, we undertake to replace the item within a reasonable time period. If this is not possible, you can choose a refund in cash or on your credit card (if used), a Restaurant credit voucher with a one year expiry date or a replacement meal. 

All claims must be made within a reasonable time from the time of supply so that we can respond appropriately to the request.

When you phone us please have your order number and contact details handy.

 

Once your order has been placed, we set about cooking straight away. Should you wish to cancel your order, please call immediately after placing your order to receive a full refund. Please do not use email when requesting a cancellation. If the restaurant has already started to process your order a 50% cancellation fee may accrue, depending on the status of the order.

The normal “cooling off” period for cancellation does not apply.

Pick-up (takeaway) and delivery menus are displayed on our website. Pricing is in Australian dollars.

 

THAi DAYS Restaurant may provide promotional offers in certain venues. Patrons should be aware that promotional offers are strictly time limited and may not be used in conjunction with any other offer. They may not be redeemable using the application.  Additional terms and conditions will be clearly stated at the time of promotion.

 

The menu for the pick-up (takeaway) and delivery service may be different from the THAi DAYS dine-in restaurant menu. Please check the menu carefully when placing your order.

 

It is your personal responsibility to ensure that your food or beverage order is consistent with your dietary requirements, including any intolerances or allergies.

 

We aim to deliver your order in a timely manner to the address provided, normally in a timeframe of 30-90 minutes, unless the restaurant is unpredictably busy. We therefore strongly recommend placing your order well in advance to avoid disappointment. We will do our very best to keep you advised of any predictable delay or unexpected delay due to circumstances outside of our control.

 

Deliveries are limited to up to a 12 kilometre radius of the restaurant and are subject to a minimum order of $30.

Website Graphics

All graphic images displayed on our menus, advertising material and on our website are illustrative only, intended for the sole purpose of giving customers a better idea of what they are ordering. Inevitably, there will be some variation in colour and minor substitution of ingredients may become necessary. Customers find our graphics a useful indication of serving size.

Menu Descriptions

All menu item descriptions in our menus and on our website are intended to convey an accurate representation of the ingredients used and the likely presentation of the dish. Our chefs reserve the right to substitute ingredients in the event of a shortage. Home-made dishes are created and cooked by us entirely from scratch.  Vegan dishes do not contain meat or fish.  Gluten free options are also available

Portion Sizes

We generally use standard 500ml, 650ml, 750 ml and 1000 ml takeaway containers for all dishes. We reserve the right to use other packaging if the need arises but this will not affect portion size. Please be aware that some dishes may settle in transit.

Complaints / Requests

THAi DAYS Restaurant will endeavour to handle all complaints as soon as possible. Please address any complaints or requests to the Manager, Thai Days Restaurant.
